Most of us do not want to think of something bad happening to ourselves or our loved ones. But it is still important to prepare for such events. Incapacity is an unpleasant subject to consider. Without proper preparation, the family of an incapacitated person may have to go through a cumbersome court-supervised guardianship process. Therefore, planning for incapacity should be one of the focal points of estate planning. It is best to make decisions regarding temporary and permanent incapacity, documenting how you would like your financial affairs and assets managed, as well as addressing healthcare-related decisions. Such preparation allows more flexibility, avoiding further unnecessary legal and court costs.
